9.2.2 Regional And National Exposure Frameworks

Regional and national documents translate international science into legal, regulatory, or administrative requirements. Their status varies: some are mandatory regulations, some are standards incorporated into regulation, and others are influential recommendations or codes that become binding only when adopted by a competent authority.

Council Recommendation 1999/519/EC on the Limitation of Exposure of the General Public to Electromagnetic Fields (0 Hz to 300 GHz). This Recommendation provides the European Union framework for protecting the general public from electromagnetic fields. It sets out basic restrictions and reference levels derived from the ICNIRP guidance available at the time and encourages Member States to adopt compatible protection measures, provide public information, and review scientific developments. Although a Council Recommendation is not directly binding legislation, this document has exerted substantial influence on national public-exposure policies throughout Europe and remains an important point of reference for European telecommunications and environmental regulation.

Directive 2013/35/EU on the Minimum Health and Safety Requirements Regarding the Exposure of Workers to the Risks Arising from Physical Agents (Electromagnetic Fields). This Directive establishes minimum occupational-health requirements for worker exposure to electromagnetic fields from 0 Hz to 300 GHz across the European Union. It defines exposure limit values and action levels and requires employers to assess risks, apply preventive and protective measures, provide information and training, consider workers at particular risk, and arrange health surveillance where appropriate. Member States implement the Directive through national law, giving it greater legal significance than a voluntary technical standard. The European Commission’s accompanying non-binding practical guides and case studies assist employers in applying its requirements.

Standard for Limiting Exposure to Radiofrequency Fields—100 kHz to 300 GHz, Radiation Protection Series S-1 (Rev. 1), Australian Radiation Protection and Nuclear Safety Agency (ARPANSA), 2021. ARPANSA RPS S-1 is Australia’s principal RF exposure standard and is aligned with the ICNIRP 2020 Guidelines. It establishes basic restrictions and reference levels for occupationally exposed persons and the general public and includes requirements for occupational risk management and public protection. The standard becomes enforceable through legislation, license conditions, workplace obligations, or other instruments that adopt or reference it. It also provides explanatory and implementation material tailored to Australian conditions.

NZS 2772.1:1999—Radiofrequency Fields, Part 1: Maximum Exposure Levels—3 kHz to 300 GHz. NZS 2772.1 is New Zealand’s principal RF exposure-limit standard and is based closely on the ICNIRP 1998 Guidelines. It remains incorporated into New Zealand’s National Environmental Standards for Telecommunication Facilities. For regulated telecommunication facilities, it supplies the exposure limits, while AS/NZS 2772.2:2016 supplies the associated measurement and computation methods. Because the exposure-limit document predates the ICNIRP 2020 Guidelines, users should distinguish the legally applicable New Zealand requirements from later international scientific guidance.

Health Canada Safety Code 6 (2015)—Limits of Human Exposure to Radiofrequency Electromagnetic Energy in the Frequency Range from 3 kHz to 300 GHz. Safety Code 6 establishes recommended Canadian limits for controlled and uncontrolled RF exposure. It applies directly to persons working at or visiting federally regulated sites and is also adopted by telecommunications regulators and other authorities for wireless equipment and infrastructure. The Code is supported by a technical guide addressing measurements, calculations, modeling, spatial and time averaging, multiple sources, and comparison with the limits. Health Canada has also issued supplementary recommendations for localized exposure above 6 GHz, which should be considered when assessing modern devices used close to the body.

United States Federal Communications Commission RF Exposure Rules—47 CFR §§ 1.1307, 1.1310, 2.1091, and 2.1093. These provisions contain the legally enforceable FCC requirements for evaluating human exposure to RF electromagnetic fields. Sections 1.1307 and 1.1310 address environmental evaluation and maximum permissible exposure for transmitting facilities, while §§ 2.1091 and 2.1093 address mobile and portable devices. The rules distinguish occupational or controlled exposure from general-population or uncontrolled exposure and specify when routine evaluation is required. They must be read with current FCC orders, service-specific requirements, and Knowledge Database procedures, which may supersede older explanatory guidance.
