Council Recommendation 1999/519/EC establishes the European Union’s common framework for limiting exposure of the general public to electric, magnetic, and electromagnetic fields from 0 Hz to 300 GHz. Adopted by the Council on 12 July 1999, it provides basic restrictions, reference levels, and principles for assessing simultaneous exposure to several frequencies. It has strongly influenced public-exposure policy across Europe, particularly for electricity infrastructure, broadcasting, telecommunications, and other sources accessible to the public.
The Recommendation is a public-health instrument rather than a workplace-safety directive. It does not address occupational exposure, which is now governed at EU level by Directive 2013/35/EU and national implementing legislation. It also does not itself create directly enforceable obligations for operators or members of the public. Its practical legal effect depends on the measures adopted by each Member State and on other EU or national legislation that refers to its limits.
Legal character and purpose
A Council recommendation is not binding legislation in the same manner as a regulation or directive. Recommendation 1999/519/EC asks Member States to establish a high level of protection using a common scientific framework while allowing them to provide more stringent protection if they consider this necessary. This combination was intended to support public health and avoid incompatible exposure approaches within the internal market.
The Recommendation recognises that restrictions should be based on the best available scientific evidence and on established adverse health effects. It also recognises that the public may encounter electromagnetic fields from many different sources and that national measures should be proportionate to the risks and benefits associated with particular technologies.
Member State responsibilities
Member States are recommended to adopt a framework of basic restrictions and reference levels for public exposure, taking account of the definitions and principles in the annexes. They should aim to ensure that the basic restrictions in Annex II are respected and should implement measures concerning sources or practices capable of exposing members of the public.
When deciding how to control a source, Member States may consider the risks and benefits of the activity. Exposure for medical purposes, where a procedure provides a recognised benefit to the person concerned, is treated differently from involuntary environmental exposure. The Recommendation therefore provides a general protection framework rather than an absolute prohibition on every exposure above a reference level.
Member States are also encouraged to provide the public with information about the health effects of electromagnetic fields and the measures taken to address them. They should promote research, collect and review relevant knowledge, and report to the European Commission on their experience. These provisions acknowledge that effective public protection includes communication and continuing scientific review as well as numerical limits.
Scientific basis
The numerical framework reflects the scientific guidance available when the Recommendation was adopted, particularly the 1998 ICNIRP Guidelines. It distinguishes established adverse health effects from other reported biological responses and uses frequency-dependent quantities corresponding to the principal known interaction mechanisms.
At very low frequencies the restrictions address effects associated with static magnetic fields and induced currents in the body. From 1 Hz to 10 MHz, current-density restrictions were selected to protect nervous-system function. From 100 kHz to 10 GHz, specific absorption rate (SAR) restrictions protect against whole-body heat stress and excessive localised heating. From 10 GHz to 300 GHz, power-density restrictions protect against excessive heating at or near the body surface.
The age of the scientific basis is important when the Recommendation is used today. Later guidance, including the 2020 ICNIRP radiofrequency guidelines, introduced revised dosimetric quantities and treatment of brief and higher-frequency exposures. Those later developments do not automatically amend the 1999 legal instrument. Users must apply the version adopted by the relevant jurisdiction and check whether national law or subsequent EU measures have supplemented its framework.
Basic restrictions
Basic restrictions are limits on quantities directly related to established biological interaction and health effects. Depending on frequency, Annex II expresses them in terms of magnetic flux density, current density, whole-body average SAR, localised SAR for the head and trunk or limbs, and power density. The restrictions include frequency ranges, averaging conditions, and provisions for pulsed exposure.
For RF exposure, whole-body average SAR addresses overall heat load, while localised SAR addresses concentrated absorption. Localised limits are spatially averaged over a specified mass of contiguous tissue. Above 10 GHz, power density is averaged over a specified area and time. The numerical value cannot be interpreted correctly without the associated frequency range and averaging instructions.
The basic restrictions are the controlling health-based criteria. Direct determination can require computational dosimetry, internal-field assessment, or specialised measurements and is often impractical during routine environmental surveys. The Recommendation therefore supplies reference levels for externally measurable quantities.
Reference levels
Annex III gives reference levels for electric-field strength, magnetic-field strength, magnetic flux density, and equivalent plane-wave power density. Additional levels address contact current from conductive objects and current induced in the limbs. The reference levels are derived using conservative assumptions about coupling between the external field and the exposed person.
Compliance with all applicable reference levels demonstrates compliance with the corresponding basic restrictions. Exceeding a reference level does not necessarily mean that a basic restriction has been exceeded or that an adverse health effect will occur. It means that the exposure requires more detailed evaluation against the basic restriction or another technically justified compliance method.
This distinction is particularly relevant for localised sources and near-field exposures. Some common devices can produce local fields above a reference level while coupling too weakly or over too small an area to exceed the relevant internal restriction. Conversely, an assessment must ensure that localised basic restrictions remain satisfied even when a spatially averaged external field appears compliant.
Multiple frequencies and pulsed fields
Annex IV provides summation rules for simultaneous exposure to fields at several frequencies. Each contribution is normalised to the applicable restriction or reference level and combined according to the relevant interaction mechanism. This prevents a site containing several individually sub-limit sources from being judged solely by considering each source in isolation.
The Recommendation also includes provisions for peak, pulsed, and transient fields. At low frequencies, frequency content and waveform affect induced-current and stimulation criteria. At RF frequencies, peak and time-averaged conditions must be considered according to the notes accompanying the tables. These provisions are important for radar, digital transmissions, intermittent sources, and other non-continuous fields.
Assessment and technical standards
The Recommendation does not prescribe one universal instrument or survey procedure. Member States may use the reference levels in Annex III or European or national standards based on agreed, scientifically proven measurement and calculation procedures. In practice, source-specific IEC, CENELEC, or national standards are used to determine field strength, power density, SAR, uncertainty, spatial averaging, and the contribution from several sources.
A reliable assessment identifies the source frequencies and operating conditions, accessible locations, duration and spatial distribution of exposure, near- or far-field conditions, and all significant simultaneous contributors. Results should be compared with the applicable national implementation rather than assuming that the Recommendation’s tables operate as stand-alone licence conditions.
Public information and precautionary measures
The Recommendation encourages information to be supplied in an appropriate form concerning the health effects of electromagnetic fields and the protective measures adopted. It also recognises that Member States may take account of precaution where appropriate, provided that measures remain proportionate and consistent with the broader Community framework.
Risk communication is therefore part of implementation. A technically compliant facility may still require clear explanation of what was assessed, which limits apply, how conservative reference levels relate to basic restrictions, and how changes in configuration will be controlled. Public monitoring or publication of results can support transparency but does not replace a source-specific compliance assessment.
Review and continuing relevance
The Recommendation calls for continuing scrutiny of scientific knowledge and for review in light of research and advice from competent scientific bodies. It also envisages Commission reports based on information supplied by Member States. This review function is important because exposure technologies, measurement methods, and international scientific guidelines have continued to develop since 1999.
Despite its age and non-binding form, Recommendation 1999/519/EC remains a central reference in the European public-exposure framework. Its basic-restriction and reference-level structure influenced national legislation, telecommunications policy, environmental assessments, and harmonised product and installation standards.
Practical significance
For RF radiation safety practitioners, the Recommendation should be understood as the EU-level foundation for general-public exposure rather than as a complete compliance standard. It identifies the health-based quantities and numerical framework, while Member State law determines enforceability and technical standards determine how compliance is demonstrated.
Its most important practical lessons are the distinction between basic restrictions and conservative reference levels, the need to consider multiple frequencies, and the separation of general-public exposure from occupational exposure. Current work should always confirm the applicable national measures and whether more recent scientific guidance or source-specific requirements have been adopted.
